This is the Privacy Policy for Dataing, Inc.  In this policy, we call ourselves “dataing” or “we” or “us.”  We call you - the person using our app or visiting our website - “you.”

1. What this Privacy Policy Covers.

This Privacy Policy applies to our mobile app and our website.  It does not apply to websites or apps that link to us, and it does not apply to websites or apps we link to.

2. What dataing does.

dataing matches people with potential romantic partners utilizing insights from their online data. dataing utilizes AI as a middleman to extract necessary insights while protecting and ensuring that you control your data. You allow us to analyze certain data within our app, and we provide insights from that analysis to our AI for matching purposes. Your data is never monetized, unless you affirmatively opt into targeted advertising or offers. In short, we have designed our app and our service so that (a) our AI can utilize data for matching you with dates and romantic partners, and (b) gets personal data from you for ads and offers only when you affirmatively provide it.

3. Data We Collect and How We Use It.

We collect data from you when you do the following:

b. Give us permission to use data from your other apps and activities.

c. Chat with CupidAI

d. Visit our website.

f. Use our app (limited to technical data about the app’s performance).

a. Data you give us when you sign up for our service.

You sign up for our service by downloading our mobile app and setting up an account.  When you set up your account, we gather only one type of data: contact information data in the form of a phone number.

We store your mobile phone number so that we can send you text messages with authentication codes, and to confirm that when you are using the app, it’s really you.  

b. Information from other apps and activities.

The idea behind dataing is to utilize social media data to infer dating preferences.  After you have set up your account with us (through the app), the app will ask you to provide access to other apps and accounts you may have, such as social media apps, health apps, financial apps, browsers, etc. dataing receives your data from those other apps, stores it in your encrypted data bank, and periodically syncs with your other apps so that the data is up to date.  

Our app then analyzes the data and sends the insights gleaned from it to dataing servers. Our system assigns a random identifier to the insights so that they cannot be tracked directly back to you. We then combine those results with the results from other dataing members, and provide aggregated data, along with your responses to our AI matchmaking engine.

c. Data you provide in response to CupidAI.

When Cupid asks you a question your answers will first be sent to OpenAI’s servers, then sent to us.  As above, our system assigns your responses a random identifier that cannot be tied back to you. We send your answers (with the random identifier) to the market researcher that asked for the survey.

d. Data we gather when you visit our website.  We also automatically collect some data about your visit to our website, as well as the browser and the device you are using.  This data includes:

We collect some of this data using cookies or similar tracking technologies handled for us by Google Analytics.  (A cookie is a small text file placed onto your computer or mobile device that allows a website to identify your specific device and browser.  You can learn more about cookies here.) Google Analytics helps us analyze how users interact with and use our website and provides other services related to our website activity and usage. The technologies used by Google may collect information such as your location, time of visit, whether you are a return visitor, and the website you reached us from (if you reached us by following a link on another site). You may forbid placement of cookies on your device by refusing to accept Cookies in the pop-up window that asks if you want to accept them.  If you reject cookies, all cookies set by Google Analytics will be removed from your browser.  Note that this may mean that some features of our website may not function properly.  You may also disable cookies in your browser settings, and delete cookies from your computer’s hard disk at any time.  

e. Data we collect when you contact us.

If you contact us by email, by phone, by regular mail, through our website, or in some other way, we will keep a record of that communication and any contact information you provide.  

f. Technical performance data.

Our mobile app will periodically send us generic, technical information about how the app is performing on your mobile device.  This will include data about your device and its operating system, your IP address, and similar data that we will use for diagnostic purposes.  If the app for some reason freezes up or crashes, when it is restarted, it will send that same data, along with technical information about what the app was doing when it crashed.  This data may include your phone number and device identifier, as well as data about the device’s operating system.  It will not include any data from your other apps or activities of the type used to participate in matching.

g. Platform Service Partners and Data Collected

We currently use the services identified in the chart below to help us provide services on the Platform and which collect information automatically. The service providers indicated in the chart, and the tracking technologies they use may change from time to time and we may engage new or different service providers from time to time. We intend to update this Privacy Policy periodically, but the chart below may be out of date. 6. Sharing Your Data.

We share your data with service providers and third parties as described below.  

Service Providers: We engage service providers to perform functions on our behalf, such as data hosting, analytics, and content management.  These service providers are required to maintain the confidentiality and security of your data and they are prohibited from using, selling, or sharing the data in any way other than to provide the services that we have engaged them to provide to us.

Other Sharing of Aggregated Data: We may analyze aggregated data and share these analyses at our discretion, including with marketing agencies, media agencies and analytics providers. For example, we may run a study that compensates you for the data and need to share visuals with news stations to advertise for dataing.

Change of Ownership or Corporate Organization: We may transfer to another entity or its affiliates or service providers some or all data about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your data the same as described in this Policy.

Law Enforcement, Legal Process, and Emergency Situations: We also may disclose your data if required to do so by law or on the good-faith belief that such disclosure is necessary to (a) comply with applicable law or legal process; (b) protect and defend our rights or property or our users; or (c) protect our personal safety or the personal safety of our users or the public.

Cross-border Transfer of Data: If you are a resident of the United States, but use the app or visit our website from outside of the United States, please understand that we may collect, process, and store your personal data in the United States and other countries.  The laws in the U.S. regarding personal data may be different from the laws of your state or country.  Any such transfers will comply with safeguards as required by relevant law.  By using the Services, you consent to the collection, international transfer, storage, and processing of your data.  If you are a resident of the EU or Switzerland, how we handle your data is set out in Section 9, below.

7. Your Options and Rights

Any single data source used in dataing can be unlinked in the dataing mobile app rendering the data bank inaccessible by dataing. You may also choose to delete your dataing account in the dataing mobile app.

You may terminate your use of our app at any time.

8. Special Information Nevada Residents

Residents of the State of Nevada have the right to opt out of the sale of certain pieces of their information to third parties who will sell or license their information to others. 9. Information for Individuals Located in the EU and Switzerland

We process personal data on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide Services; and (3) as necessary for our legitimate interests in providing the Services where those interests do not override your fundamental rights and freedom related to data privacy. Personal data we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or subcontractors maintain facilities, as described above.

10. California Do Not Track Disclosure

We do not respond to Do Not Track signals from browsers, because we do not track your activities over time or across websites.

11. Additional Information for California Residents

The California Consumer Privacy Act takes effect on January 1, 2020.  California Civil Code Section 1798.83 permits individual California residents to request certain information regarding our disclosure of certain categories of Personal Information to third parties for those third parties’ direct marketing purposes as permitted by this Privacy Policy. To make such a request, please contact us using the information in the “Contacting Us” section below. This request may be made no more than once per calendar year, and we reserve the right not to respond to requests submitted other than to the email or mailing addresses specified below.

Use of Google Services
Our application integrates with Google services, specifically Google Calendar and YouTube, to enhance your experience and facilitate the dating process. Below is how we access, use, store, or share data from these services: YouTube: To help you find compatible matches based on your interests, our application accesses and stores data from your YouTube account, including your liked videos. This data is used to determine potential dating partners who share similar interests. Your liked videos may also be displayed to potential matches within the app to foster a connection based on common interests. Google Calendar: To assist in scheduling dates, our application uses Google Calendar. When you find a match and both parties consent to a date, our application can create an event in your Google Calendar. We store information about these events to help manage your schedule and ensure that you are not double-booked. Your calendar data is only accessed with your consent and is used solely for the purpose of scheduling dates. Data Security and Privacy: We take the privacy and security of your data seriously. Access to your Google user data is governed by our privacy policy and is limited to the purposes outlined above. Our application utilizes advanced technologies, including large language models such as OpenAI's ChatGPT, to enhance the user experience and personalize your dating matches. To achieve this, we may share the following personal data with these third-party tools: YouTube: Liked videos from your connected YouTube account. Instagram: Posts from your connected Instagram account. Facebook: Posts from your connected Facebook account. Pinterest: Pins from your connected Pinterest account. This data is shared purely to improve the functionality of our app, such as personalizing your dating matches based on your interests and social media activity. We ensure that any data shared with third-party tools is done so in accordance with our privacy policy and with the appropriate safeguards in place to protect your privacy.
